Kata K.'s Private Commission Terms of Service

The following Terms & Conditions are for the Commission of original artwork or designs from Kata Kemi. The following information must be read fully and accepted before signing and dating the final Commission Agreement, which is legally binding. By commissioning Kata Kemi in any kind of way, you are agreeing to the terms of service below.

These Terms of Service apply to NON-COMMERCIAL projects only. For commercial projects, terms will be defined in a contract. Contact via business email to discuss further for such.

Terms of Service

Once contacted about interest in commission, once the private commission slots have been opened, I will contact the client via email or Twitter DMs.1. GENERAL TERMS
-The Artist has the right to refuse any Commission request, without needing to explain the reason.
-The Artist reserves the right to Stop Work on a Commission, or cancel a Commission request due to poor communication, inappropriate behavior, an inability to effectively communicate in the English language, or a breach of the Terms of Service.-No NFT or AI based works. The Artist's work is forbidden to be involved in any of them. No permission granted.-Usual policy is first come first serve for the commission que. May be changed.

2. PAYMENT

-The Artist will send the payment via Paypal invoice. Once the invoice has been paid upfront, the Artist will proceed with starting the commission.
-If the commission payment is split in half, the work will be paused untill the second half of the payment is paid as discussed.
-The Artist is responsible for all applicable taxes,including state sales/use and
excise taxes, local and federal taxes.
-All prices are expressed in U.S. dollars (USD); foreign currency must be converted during the payment process. The Client is responsible for providing the correct amount, equal to the USD amount due.

3. PROCESS AND DELIVERY

-The Client will be contacted shortly before the Artist is ready to begin their commission. The Client needs to provide the needed information shortly by then.- The Client must specify the content of their Commission to the best of their ability prior to a Commission Agreement. A complex Commission may incur additional illustration fees or extend the Commission schedule, to be defined and agreed upon in the Commission Agreement prior to Start of Work.-The Artist will send a sketch proof to the client before proceeding to finish the art piece. At the sketch phase, all revisions are free of charge. Once both parties have agreed on the sketch, and to be continued to be polished and finished, but beyond this point the client wishes for changes in the piece, additional fees may include for major changes.-If the Commission is time-sensitive, a rush fee may be applied and schedule adjusted.-The Client will receive high quality digital files of the Commission once the Artist has finished the project. Either via email, or WeTransfer.

4. COPYRIGHT / USAGE POLICY

-The Artist will not reproduce a copyrighted image or character without consent of its copyright owner, and as it pertains to United States Copyright Law.
Unless the company itself is ok with fanart being sold by freelancers without their permission. (Such as Arenanet etc)
-The Artist retains all rights to the Commission, which includes but is not limited to: Distribution, reproduction, use of the Commission for Artist promotion and displays (e.g. Social Media)-If the Commission will be used for a Commercial Purpose, the Artist must be notified prior to the Start of Work. Commercial use of the Commission requires new Terms of Service developed on a case-by-case basis and agreed to by all parties in the Commission Agreement before the Start of Work.- The Client will not permit any use of the Commission or misuse the Artist’s name in any way which would reflect discredit on his reputation as an artist, or which would violate the good spirit of the Commission.

6. REFUND / CANCELLATION POLICY

-The Artist has the right to refuse any Commission request, without needing to explain the reason.-Refunds may only be issued if the Client notifies the Artist prior to Start of Work. No refunds will be issued after Start of Work, nor will a refund be issued before or after Start of Work if any Terms of Service are breached.-If the Artist informs she cannot for whatever reason begin the commission, the Client will receive full refund, if already paid via invoice for it.


These terms and conditions are subject to revision without notice. The Client is responsible for reviewing and agreeing to the Terms of Service before entering into a Commission Agreement with the Artist. Once the Client enters into a Commission Agreement with the Artist, it is assumed the Client has agreed to all Terms of Service.
